Lower barriers as main goal of prejudicial appeals

“The main goal of the resolution on prejudicial appeals is to lower barriers for both controlling agencies and service consumers,” Analytical Center project head Konstantin Tsvetov told Rossiyskaya Gazeta, as he was commenting on the government resolution drafted by the Economic Development Ministry together with the Ministry of Digital Development, Communications and Mass Media and the Analytical Center.

Companies will be able to file prejudicial appeals against the decisions of the state fire inspectorate, the state regulator overseeing quality and safety of medical services, the state occupational safety inspectorate, and other controlling agencies starting on July 1, 2021, Rossiyskaya Gazeta said. The document has been published for public discussion.

The electronic prejudicial appeal procedure will minimize legal costs and will ensure a rapid response to the violations that may be uncovered in the course of appeal processing, Tsvetov said.

“Importantly, the appeal procedure will have a unified timeframe and will be conducted online. This means the applicant will not have to pay an in-person meeting to the authority and to submit an excessive package of documents,” the newspaper quoted the Analytical Center’s expert as saying.
