The Ministry of Economic Development is closely monitoring the implementation of the first stage of the oversight and supervision reform - introduction of the mechanisms for training and self-instruction of supervised persons based on personal accounts. The pilot form of the oversight should be determined, the list of key requirements for it should be generated and the personal account for control subjects should be developed by year end. The first progress was reported by the representatives of the agencies participating in the project during the workshop held on March 14 at the Analytical Center for the Government of the Russian Federation.
“During the course of 2017 this work should affect 15% of controls included in the core list,” explained the director of the Department of State Regulation in Economy of the Ministry of Economic Development, Nadezhda Mashkova. The self-examination that the subjects of control can perform based on the information from regulatory agencies will reduce the workload of the oversight authorities by transferring some of the responsibility to their controlled entities. But such self-examination will require exact instructions from the controller, for example, checklists. It was expected that the work will be based on the lists of laws and regulations, which should have been developed by the agencies for the assigned types of control. However, according to Mashkova, the work performed was of poor quality, and in some cases it was necessary to start from the beginning.
Each supervisory authority can select at least one "pilot" type of oversight and develop a complete and transparent algorithm to work with it. It is important that the choice is left to the agency, therefore the most "advanced" type of oversight, which is most ready for structuring, can become pilot. A difficult stage for virtually all agencies will be the development and implementation of the personal account. But without this important link of information system development the reform process will stop and the question of who in the end will benefit from it will remain unanswered.
"Of course, first and foremost, we look forward to the introduction of the system of personal accounts for massive supervised entities," said the representative of the Ministry of Economic Development of the Russian Federation.
The representatives of the agencies talked about the progress of the work. Thus, Roszdravnadzor chose as pilot the supervision of drug circulation, Rostekhnadzor chose as pilot the activity of SRO, FCS chose as pilot customs control, EMERCOM chose as pilot state firefighter and license control. Rostransnadzor advanced a little further, not only by defining the pilot types of oversight, including the transport safety designated by the agency, but also by approving the prevention program for 4 modes of transportation. Rostrud experience seemed useful for its colleagues. The agency developed the topic of compliance with labor legislation - it published a list of mandatory requirements, created the schedule of events (four of them in 2017). The representative of the agency said that using the information provided by them over 192,000 employers completed the self-assessment, and the majority found no violations.
Most questions from the agencies and the Ministry of Economic Development were raised by the practical implementation of personal accounts. Oleg Kachanov, Deputy Director of the Department of Projects on Digitalization of the Ministry of Telecom and Mass Communications of Russia, present at the meeting, explained that no single template or terms of reference are planned to be developed to assist the authorities, meaning that each agency will solve this problem independently. With regard to controlled legal entities, they have the possibility to create personal accounts on the Portal of state services after completing the registration procedure, and over 260 thousand personal accounts were already created there. In addition, at the initial stage of implementation of training and self-instruction mechanisms, official websites of the agencies can be used.
However, the types of control are divided into priority and other, mass and narrowly focused, involving interactive communication with the controller and those, where this aspect is not important. And this must be taken into account when designing a system that will be implemented in stages over 2017 and 2018. At the first stage, in 2017, information services will be created, i.e. alerts of control subjects about upcoming audits that are included in the general registry. The preventive function tipping the user on further actions is also important. Later, in 2018, the services of declaration and appeal of prescription will be implemented.
